These Terms and Conditions (“Agreement”) govern the services provided by Home Check Gurus (“Company,” “we,” “us,” or “our”) to the client (“Client,” “you,” or “your”). By engaging our services, you agree to the following terms:

 

1. Scope of Services

 

Home Check Gurus provides visual home watch and concierge services, including scheduled property inspections for vacant or seasonal homes.

• Services are non-invasive, visual inspections only

• We do not perform technical, mechanical, or licensed inspections unless specifically agreed upon

• We do not move heavy objects, dismantle systems, or perform repairs unless separately contracted

 

A detailed checklist of services will be provided and agreed upon prior to service initiation.

 

2. No Guarantee Against Loss

 

While we take reasonable steps to identify visible issues:

• We do not guarantee the prevention of damage, loss, theft, vandalism, or system failure

• We are not responsible for hidden defects or latent issues

• Our services are intended to reduce risk, not eliminate it

 

3. Client Responsibilities

 

The Client agrees to:

​

• Maintain active homeowners insurance coverage

• Ensure all utilities (unless otherwise agreed) remain operational

• Provide accurate emergency contact information

• Notify us of any changes to the property, access instructions, or systems

 

Failure to meet these responsibilities may limit our ability to perform services.

 

4. Access to Property

 

Client must provide safe and reliable access, including:

• Keys, lockbox, keypad codes, or other entry methods

• Authorization for us to access the property during scheduled visits

 

We are not responsible for missed visits due to access issues beyond our control.

 

5. Reporting

 

After each visit, the Client will receive a report which may include:

​

• Written summary

• Photos and/or videos (when applicable)

• Notification of any visible concerns

 

Reports reflect conditions observed at the time of visit only.

 

6. Emergency Situations

 

If an issue is identified that requires immediate attention:

​

• We will attempt to contact the Client first

• If unreachable, we may contact the designated emergency contact or appropriate service provider

• We may take reasonable action to prevent further damage

 

Any third-party services will be billed directly to the Client.

 

7. Additional Services & Fees

 

Services outside the standard agreement may include:

​

• Storm preparation or post-storm checks

• Meeting vendors or contractors

• Concierge services

 

These services may incur additional fees, which will be disclosed in advance whenever possible.

 

8. Payment Terms

​

• Payment is due as outlined in your service agreement (monthly, quarterly, etc.)

• Late payments may result in suspension of services

• We reserve the right to charge late fees where permitted by law

 

9. Limitation of Liability

 

To the fullest extent permitted by law:

​

• Home Check Gurus’ liability is limited to the amount paid for services in the prior 30 days

• We are not liable for indirect, incidental, or consequential damages

• We are not responsible for acts of nature, including hurricanes, floods, or other natural disasters

 

10. Insurance & Licensing

 

Home Check Gurus maintains appropriate business insurance.
We are a home watch service, not a home inspection company unless otherwise stated.

 

11. Independent Contractors

 

We may recommend or coordinate third-party vendors; however:

​

• We are not responsible for their work, performance, or outcomes

• The Client assumes all responsibility for hiring and payment unless otherwise agreed

 

12. Cancellation & Termination

•  

• Either party may terminate services with written notice (typically 7–30 days)

• No refunds will be issued for services already performed

• Prepaid services may be prorated at our discretion

 

13. Indemnification

 

Client agrees to indemnify and hold harmless Home Check Gurus from any claims, damages, or liabilities arising from:

• Property conditions

• Failure of systems

• Acts beyond our control

 

14. Privacy

 

We respect your privacy:

​

• Client information will never be sold or shared without consent

• Photos and reports are confidential and used solely for service purposes

 

15. Governing Law

 

This Agreement shall be governed by the laws of the State of Florida.

 

16. Entire Agreement

 

This document, along with any signed service agreement, constitutes the entire agreement between the parties.

 

17. Acceptance of Terms

 

By engaging Home Check Gurus, the Client acknowledges that they have read, understood, and agree to these Terms and Conditions.

 

18. Hurricane & Named Storm Policy

 

Due to the nature of severe weather in Florida:

​

• Services may be suspended, delayed, or rescheduled before, during, and after any named storm, hurricane, tropical storm, or severe weather event

• Home Check Gurus does not guarantee property access or inspection during unsafe conditions

• We are not liable for any damage, loss, or missed issues resulting from:

  • Hurricanes or tropical storms

  • Storm surge or flooding

  • Wind damage or debris

  • Mandatory evacuations or restricted access

 

Storm Preparation & Post-Storm Services:

​

• Pre-storm and post-storm visits are considered additional services and may incur extra fees

• Availability is not guaranteed due to high demand and safety conditions

 

19. Water Intrusion & Leak Limitation

 

Florida properties are especially vulnerable to water-related damage. Client acknowledges:

​

• Inspections are visual only, and we cannot detect:

  • Hidden leaks inside walls, ceilings, or underground

  • Slow or intermittent plumbing failures

  • Roof leaks not visible at the time of inspection

 

Home Check Gurus is not responsible for:

​

• Undetected water intrusion

• Damage caused by leaks, broken pipes, appliance failures, or roof issues

• Mold growth or structural damage resulting from moisture

 

We strongly recommend:

​

• Automatic water shut-off systems

• Leak detection devices

• Routine professional inspections for plumbing and roofing systems

20. Mold & Humidity Disclaimer

Due to Florida’s high humidity environment:

​

• Mold can develop rapidly and without visible warning

• Our services do not include mold inspection, testing, or air quality analysis

 

Home Check Gurus is not liable for:

​

• Mold growth or spread

• Air quality issues

• Health effects related to mold or mildew

 

We recommend:

​

• Maintaining proper HVAC operation at all times

• Using dehumidifiers or humidity control systems

• Scheduling licensed mold inspections when necessary

 

21. Air Conditioning & Humidity Control

 

Client acknowledges the importance of climate control in Florida:

​

• The property’s air conditioning system should remain operational at all times unless otherwise agreed

• We will visually check thermostat readings but do not guarantee system performance

 

Home Check Gurus is not responsible for:

​

• HVAC system failure

• Resulting humidity damage, mold growth, or interior deterioration

 

22. Pest & Wildlife Intrusion

​

Florida homes are susceptible to pests and wildlife, including insects, rodents, and reptiles.

​

• Our inspections may note visible signs of infestation

• We do not provide pest control services or inspections

 

We are not liable for:

​

• Hidden infestations

• Damage caused by pests or wildlife

 

23. Pool, Spa, and Exterior Systems Disclaimer

 

If applicable:

​

• Pools, spas, irrigation systems, seawalls, and docks are checked visually only

• We do not test water chemistry, structural integrity, or mechanical systems

 

Home Check Gurus is not responsible for:

​

• Equipment failure

• Algae growth or water condition issues

• Structural or underground system failures

 

24. Utility Failure Disclaimer

​

We are not responsible for conditions resulting from:

​

• Power outages

• Internet or security system failures

• Water service interruptions

 

These may prevent us from completing a full inspection.

​

25. High-Risk Environmental Factors

​

Client acknowledges that Florida properties face elevated risks, including:

​

• Flood zones and rising groundwater

• Salt air corrosion (near coastal areas)

• Rapid vegetation growth affecting structures

 

Home Check Gurus is not liable for environmental damage or long-term deterioration caused by these factors.
